PRODUCT DESCRIPTION

Each product purchased is sold subject to its Product Description which may set out additional Specific Conditions related to that Product including, without limitation, terms and conditions concerning estimated delivery dates and times, warranties, guarantees and after-sales service.
The Company will take all reasonable measures to ensure that all product descriptions, further information and prices of Products appearing on the Website are correct at the time all relevant information pertaining to product was entered onto the system.
The Company will endeavour to keep products and or product descriptions on the Website as up to date as practical in the circumstances, however it may not in certain instances reflect the position at that same time an order is placed. The precise cost of a Product will be confirmed on acceptance of your order and in strict accordance with our acceptance policy.

WARRANTY

Your Cogsmith products are warranted by Cogsmith for a period of Twelve (12) months from the date of purchase under the terms and conditions of this warranty. During the warranty period and by presenting receipt of purchase, you will have the right to have specified defects repaired free of charge.
In the event that repairs are improper to restore the normal conditions of use of your Cogsmith® product, Cogsmith® guarantees its replacement of identical or similar characteristics. The warranty for the replacement product ends twelve (12) months after the date of purchase of the replaced product.
This manufacturer’s warranty does not cover:
– Batteries;
– Water damage;
– Heat Damage.
– Normal wear and tear and aging (e.g. scratches; alteration of the colour and/or material due to bleaching, chemical damage from cleaning products);
– Any damage on any part of the product resulting from abnormal / abusive use, lack of care, negligence, accidents (knocks, dents, crushing, broken parts, etc.), incorrect use of the product and non-observance of the use directions provided by Cogsmith©;
– Indirect or consequential damages of any kind resulting from e.g. the use, the non-functioning, the defects or the inaccuracy of the Cogsmith® product;
– The Cogsmith® product handled by non-authorized persons (e.g. for, services or repairs) or which has been altered in its original condition beyond Cogsmith’s® control.
Any further claim against Cogsmith® e.g. for damages additional to the above described warranty is expressly excluded, except mandatory statutory rights the purchaser may have against the manufacturer.
A return shipping and handling fee may apply to all warranty service.
This warranty is void if the product has been damaged by accident, negligence, unauthorized service, or other factors not due to defects in material or workmanship.
The above manufacturer’s warranty:
– is independent of any warranty that may be provided by the seller, for which they carry sole responsibility;
– does not affect the purchaser’s rights against the seller nor any other mandatory statutory rights the purchaser may have against the seller.

Please Note: This address is for mail-in only. We encourage you to send your package certified, insured or through a traceable shipper. Cogsmith & Co are not responsible for packages lost or stolen in transit to us.

Please allow up to 4 to 6 weeks from the date we receive your package for your product to go through the repair process.

REGISTRATION
You certify that you will not impersonate any person and or entity, or use a false name that you are not authorised to use. You further certify that when you register as a customer the information you provide is true, accurate, current and complete in all respects. Any changes to your Personal Information must be notified to The Company by email on jane@cogsmith.co.uk

INDEMNITY

You agree to indemnify, defend and hold The Company harmless immediately on demand, from and against all claims, liability, damages, losses, costs and expenses, including legal fees arising out of any breach of the Conditions by you, and or any other liabilities arising out of your use of the Website, or the use by any other person accessing the Website using your shopping account, and or your Personal Information.

OUR RIGHTS

The Company reserves the right to modify and or withdraw, temporarily or permanently, this Website, or any part thereof with or without prior to notice to you. You confirm that The Company shall not be liable to you or a third party for such modifications and or withdrawal. Your continued use of the Website, or any part thereof shall be deemed as acceptance of any such change.

OUR SHOPS

We utilize shops run by third parties and they do not endorse Cogsmith & Co nor do we endorse them, their terms and conditions of sale prevail in all cases.

PRIVACY POLICY

Cogsmith® is a limited company. The Company is committed to the preservation of the privacy of all visitors and customers to The Company website at www.Cogsmith.co.uk. 
By registering and or placing an order on this website, you consent to the collection, usage and transfer of your information under the terms of the said Privacy Policy.
Any information you provide may be accessed by, and or given to third parties who act on behalf of The Company in the process of information, delivery of orders, process credit card payments and provide support services on our behalf.
The Company may also use such information you provide to notify you of any new products, clearance products or any general information pertaining to The Company in relation to collating information for analysis, improvement and development of the business.

TERMS OF PAYMENT

Payment for the Goods shall be made at the time of purchase, unless otherwise agreed between The Company and the customer.

DELIVERY

Once an order has been received and payment cleared The Company will endeavour subject to availability of products to deliver within 7 working days, unless the customer is otherwise notified. It is imperative that the contact details provided when placing an order are correct.
We use various couriers with either next day UK delivery, 1-2 business day delivery or we personally deliver the items, usually discussed with the customer and especially for larger items. If sent by courier they are sent with full tracking and depending on size / value a signature may be required on delivery. Please make sure your contact details are correct at the checkout as you may receive tracking information via text or email from our courier.

RETURNS

The Company will strive to offer you a first class shopping experience, however should you for any reason not be happy with your purchase or goods arrive damaged or faulty please contact jane@cogsmith.co.uk within a period of 24 hours. Goods returned outside the stipulated time limit are at the discretion of The Company.
It is imperative that your purchase is returned direct to The Company within 7 days from the date of invoice and in their original condition and packaging. Goods must be sent either by registered post or courier. The Company will not be held responsible for goods sent by ordinary mail whether lost and or damaged. The company will not be responsible for any postage costs in returning the item. The company will also not refund the cost of the original postage costs at the time of the purchase.
The Company will give a credit note to the amount paid for the goods. No refund will be given for postage paid for delivery or returns. Products made to your specific requirements cannot be returned or refunded. This does not affect your statutory rights.
The Company will make arrangements for a replacement to be sent however this will be subject to the availability of the product concerned.
In the event of failure to return any goods to The Company as referred to above, we shall have the right to charge any costs of the goods. 
All items that are in the sale are non refundable, they are returnable and a credit note will be issued if there is no replacement size or alternative product.

TITLE

Goods remain the property of the company until the customer has paid the agreed price for the goods, including any other amounts owed. Title will pass once payment has been cleared.

FORCE MAJEURE

In the event that The Company is prevented, hindered or delayed in the supply of goods in accordance with these Conditions by an event beyond the reasonable control of the company, it may be the option of the company to suspend the delivery while the Force Majeure Event continues, or if stocks are insufficient to meet it’s commitments, apportion stock available between it’s customers, or terminate a contract affected in writing to the customer. The Company will not be liable for any loss or damage suffered by the customer as a result.

CONFIDENTIALITY AND DATA PROTECTION

The Company will keep confidential any information provided by the customer in relation to the contract, with the exception of general personal information which may used as detailed above.
The Company will be responsible for ensuring that the processing of personal data complies with the Data Protection Act 1998.

LEGAL COMPLIANCE

You may use the Website only for lawful purposes and in a lawful manner. By using the Website you agree to hereby comply with all applicable laws, statutes and regulations pursuant to the Website and any transactions conducted and or through the Website.

INTELLECTUAL PROPERTY

You agree by use of the Website that all copyright, trademarks and or all other intellectual property rights in all material or content supplied hereto shall remain at all times vested in The Company and our licensors.
You agree that the material and content contained within the Website is made available for your personal non- commercial use only, and that you may if necessary in the completion of a purchase download such material and or content onto one computer hard drive for such a purpose. Any other use of the material and or content of the Website is strictly prohibited.
You agree not and or facilitate any third party to copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material and or content.

GOVERNING LAW

A Contract is governed by English Law. The Courts of England have exclusive jurisdiction in any dispute resolution arising from or in connection with a Contract. Both the company and the customer submit to the exclusive jurisdiction of the English and Welsh courts in relation to any dispute howsoever arising from the contract.
